Checking the facts on latest McAuliffe ad

With the first governor's debate now in the books, the political ad season is beginning to ramp up.

At WSLS 10 we're checking the facts in these ads, starting with one released by Democratic gubernatorial candidate Terry McAuliffe.

The minute long ad focuses on Shirley Keen of Raven, Virginia.

She's in the middle of a money dispute with an energy company that is taking methane gas from her property.

About halfway through the ad, Keen claims the attorney general's office is taking the side of energy companies.

"Ken Cuccinelli's office was giving information to the energy companies to fight us," she said in the ad.

This is true.

In June, e-mails between an assistant attorney general and lawyers with the CNX Gas Company came to light.

While reviewing a class action lawsuit request a U.S. magistrate judge called these e-mails "shocking", saying the assistant attorney general provided advice and information to CNX.

However, Cuccinelli's office called the e-mails "overzealous", maintaining they were ethical.

"Then Cuccinelli got $100,000 for his governor's campaign," said Keen in the ad.

This is also true, but misleading.

The graphic references money given to Cuccinelli's campaign by Consol Energy, the parent company of CNX.

According to the Virginia Public Access Project, Consol Energy has donated more than $100,000 to the Republican gubernatorial candidate.

However at this point, nothing has linked the advice and information given to the gas companies by the assistant attorney general directly to Cuccinelli.

Consol Energy has also been donating to Cuccinelli's campaign for more than a year.

The company has donated to more than a dozen other candidates running for state office.
